DECREE OF THE MINISTER OF TRADE

CONCERNING
STIPULATION OF SURVEYORS AS EXECUTORS OF TECHNICAL VERIFICATION OR INQUIRY INTO THE IMPORT OF COLOR MULTIFUNCTIONAL MACHINES, COLOR PHOTOCOPY MACHINES AND COLOR PRINTERS

THE MINISTER OF TRADE,

Considering:

• a. That in the framework of implementing the provision in Article 7 of regulation of the minister of trade No. 15/M-DAG/PER/3/2007 on provisions on the import of color multifunctional machines, color photocopy machines and color printers, it is necessary to stipulate surveyors as executors off technical verification or inquiry into the import of color multi-functional machines, color photocopy machines and color printers;
• b. That based on the consideration as intended in paragraph a, it is necessary to stipulate a decree of the minister of trade;

In view of:

• 1. Presidential decree No. 260/1967 on affirmation of tasks and responsibility of the minister of trade in the foreign trade sector;
• 2. Presidential decree No. 187/M/2004 on the establishment of the United Indonesia Cabinet as has already been amended several times and the latest by presidential decree No. 171/M/2005;
• 3. Presidential regulation No. 9/2005 on status, tasks, functions, organizational structures and working arrangement of state ministries as has already been amended several times and the latest by presidential regulation No. 94/2006.
• 4. Presidential regulation No. 10/2005 on first-echelon Organizational units and Tasks of stare ministries as has already been amended several times and the latest by presidential regulation No. 91/2006;
• 5. Decree of the minister of Industry and Trade No. 229/MP/KEP/7/1997 on general Import Provisions;
• 6. Joint decree of the minister of finance and minister of industry and trade No. 527/KMK.04/2002 and 819/MPP/KEP/12/2002 on administrative order of import;
• 7. Decree of the minister of Industry and trade No. 40/MPP/KEP/1/2003 on Importer Identity Number (API) as has already been amended by regulation of the minister of trade No. 43/M-DAG/PER/12/2006.
• 8. Regulation of the minister of trade No. 01/M-DAG/PER/3/2005 on organization an working arrangement of the trade ministry as has already been amended by regulation of the minister of trade No. 30/M-DAG/PER/12/2005;
• 9. Regulation of the Minister of trade No. 15/M-DAG/PER/3/2007 on Provisions on the Import of color Multi-functional machines, Color Photocopy machines and color printer.

Observing:

• 1. Letter of the President Director of PT. Sucofindo (persero) No. 292.1/DRU-IV/SPMM/2007 dated April 2, 2007 on Application for Having Appointed as surveyor Verifying the Import of color Multi-Functional Machines, color photocopy machines, and color printers;
• 2. Letter of the President Director of PT. Surveyor Indonesia (Persero) No. 007/PDR-IV/TFS/2007 dated April 2/2007 on application for Having appointed as surveyor of color Multi-functional machines, color photocopy machines and color printers;

HAS DECIDED:

To stipulate:

FIRST:

PT. (Persero) Superintending company of Indonesia or PT. SUCOFINDO (Persero) and PT. Surveyor Indonesia (Persero) as executors of technical verification and inquiry into the Import of color Multi-functional machines, color photocopy machines, and color printers.

SECOND:

The surveyors as intended in first article have the following tasks:

1. verifying to inquiring technically the Import of color Multi-functional machines, color photocopy machines, and color printers;

2. Issuing surveyor report (LS) based on data/information obtained from results of examination of related documents and physical inspection of the would-be imported color multi-functional machines, color photocopy machines and color printers;

3. Printing LS as intended in paragraph 2 on security paper in two languages, namely Indonesian and English languages by mentioning at least data/information about:

• a. name and address of importee;
• b. mark, type and quantity (volume) of goods;
• c. description and specification of goods, covering tariff headings;
• d. country of origin of goods and shipment period;
• e. loading port; and
• f. signature of authorized officer/ official of surveyor.

4. assuring that the would-be imported color multifunctional machines, color photocopy machines and color printers have been verified and in accordance with the issued LS;

5. appointing executive officer of verification and official authorized to sign LS, accompanied by specimen of signature of the official and conveying it to the director General of Foreign trade and director general of customs and Excise;

6. conveying written report on activities of technical verification or inquiry every month to the director general of foreign trade in this case the director of Import with a copy made available to the Chairman of the Coordinating Board for Combating fake money (BOASUPAL), director General of Transportation Equipment and Telemetric Industries (IATT) of the ministry of industry and director general of domestic trade in this case the director of supervision over goods in circulation and services in not later than the 15th of the ensuing month.

THIRD:

the technical verification or inquiry as intended in DICTUM SECOND is applied to the color multi-functional machines, color Photocopy Machines and color printers as contained in attachment I to regulation of the minister of trade No. 15/M-DAG/PE/3/2007

FOURTH:

In connection with the technical verification or inquiry into the Import of color multi-functional machines, color photocopy machines and color printers, surveyors collects compensation for the rendered service form importers with the amount stipulated by observing the benefit principle.

FIFTH:

All costs spent for the implementation of technical verification inquiry become responsibility of surveyors.

SIXTH:

Stipulation of the surveyors as intended in FIRST article does not abolish authority of the minister of trade to revoke, replace and supplement surveyors as executors of color multi-functional machines, color photocopy machines and color printers.

SEVENTH:

The decree comes into effect as from the date of stipulation.
